INANDOUTOFAFRICA encourages bidders to be familiar with these documents as they set out the terms on which property is bought at the auction.

BIDDER REGISTRATION

We require prospective buyers to register before bidding at the auction.

All first-time registrants will be required to supply a bank reference to complete this process.

We may execute bids on behalf of the seller up to the amount of the reserve, either by placing consecutive bids or by entering bids in response to those made by others. After the reserve is met, we will not execute any further bids.

INANDOUTOFAFRICA will executive a bid at the lowest possible price taking into account the reserve price. If identical bids are made for the same lot, the first bid received will take priority.

THE “BUY NOW” BUTTON

Buyers who do not wish to go through the bidding process for a particular property or risk being out-bidded for a lot may take the offer on the “Buy Now” button.

Confirmation of a payment on any of our payment platforms locks down the lot for the buyer.

SUCCESSFUL BID

A successful bid is conveyed to the buyer at their preferred contact address, indicated during registration. The successful bidder will pay the hammer price plus applicable costs such as shipment, value added tax and charges for an export certificate.

The reserve price is minimum hammer price for which the work will be sold. If the reserve is not met, the lot will remain unsold. The reserve does not exceed the low pre-sale estimate but the sum remains confidential.

PAYMENT

Payment must be made within seven calendar days of sale.

The buyer, while assuming responsibility for the completion of payment, will not acquire title and possession of the lot until all amounts due have been paid. Payment is accepted in the form of telegraphic transfer in currency value of the buyer’s location. Cheques will be accepted only if a prior call is made to that effect, or indicated as a payment preference during the registration.

Where the buyer is resident in the same city or country as the location of the property, they can arrange for their own pick-up of the property. Where the buyers as resident elsewhere INANDOUTOFAFRICA will be responsible for shipment on behalf of the buyer and handle export permits and insurance.

COLLECTION

Full names and contact addresses are to be as indicated in the registration. This will be the legal recipient of the property.

Shipment is commenced within 7 days of payment.

CONDITION REPORTS

Condition reports are provided as a service to interested clients. Prospective buyers should note that descriptions of property are not warranties and that each lot is sold “as is”.

Other conditions and information

(a) All metric dimensions are approximate. Ample care is however taken to ensure accuracy as much as possible.

(b) Costs and estimates are calculated in USA Dollars, Nigerian Naira, Euros and British Pounds.

Buyers paying outside of these zones can have currency translated into any of the above currency fields.

Where the work is previously owned by a private or public collection, and the buyer requires an authentication certificate, the buyer will be furnished with one from the author (artist) or his or her estate at the buyer’s expense.

PRECONDITIONS

  • In good faith to the buyers, signed declarations by the seller warrant the following
  • The seller is the owner of the item, or is property authorized by the owner to sell the item.
  • The seller can and shall, in accordance with the conditions set upon him, transfer possession to the buyer with good and marketable title to the item, free from any third party rights, claims or potential claims (including without limitation, by government or governmental agencies).
  • Information regarding titles, year of creation, author are as supplied by the seller and INANDOUTOFAFRICA takes no responsibility for eventual inaccuracies even while great care has been taken to ensure accuracy of information on each item.
  • References to damage and restoration are for guidance only and absence to such references does not imply that an item is free from defects or restoration, nor does a reference to particular defects imply the absence of any others.

BEFORE THE SALE

  • A prospective buyer must complete and sign a bidder registration form. INANDOUTOFAFRICA may require the production of bank or other financial references.
  • When making a bid, a bidder is accepting personal liability to pay the purchase price with all applicable taxes and any other applicable charges.
  • The reserve price is the confidential minimum price for the lot. If bidding for a particular lot ends below the reserve, the lot will not be sold. The reserve will not exceed the low estimate printed in the catalogue. INANDOUTOFAFRICA may open the bidding on any lot below the reserve and may continue to bid on behalf of the seller up to and strictly limited to the amount of the reserve, either by placing consecutive bids or by placing bids in response to other bidders.
  • INANDOUTOFAFRICA shall be entitled to retain items sold until all amounts due have been received in full in good cleared funds or until the buyer has satisfied such other terms as we, in our sole discretion, shall require.
  • Reasonable effort shall be ensured to take care when handling, packing and shipping a purchased lot. Where damage or any acts of third parties occur, the buyer will be entitled to insurance settlements only to the tune of insured sum.
  • On the conclusion of a transaction and receipt of payment, transaction cannot be rescinded or cancelled.
  • Where buyer indicates that he/she will undertake private collection of property, we shall retain the property not later than 7 days following purchase, after which the buyer will bear risks and costs of storage.
  • All works are sold without the frames but assistance will be readily given to the buyer in choosing appropriate framing.

INANDOUTOFAFRICA is owned, operated and managed by Arthouse Corporate Services registered in Nigeria. Some of its acquisitions where made on its behalf by its multimedia production sister company Back Page Productions Limited registered as a limited liability company in Nigeria. As such Arthouse Corporate Services is the legal contracting party for all auction transactions by INANDOUTOFAFRICA and with regard to legal claims and contracts.

The copyright for all images, illustrations and written materials produced by and for INANDOUTOFAFRICA relating to a lot is and shall remain at all times the property of Arthouse Corporate Services. They shall not be used by anyone without our prior written consent.
